Financial remedy

This is the procedure by which financial matters are sorted out following on from a divorce or civil partnership dissolution. The matters which the court takes into account in considering financial issues are set out in section 25 of the Matrimonial Causes Act 1973. Financial issues can be resolved through mediation or using the collaborative law process or by negotiations either directly between the partners or via solicitors. In all cases there will need to be “full and frank” financial disclosure between the partners so that any decisions made are made with the benefit of knowing what assets, income, debts and liabilities there are. Ideally whatever the process chosen, an agreement will be reached between the partners, which then must be set out in a consent order which is approved by the court.
