What is Financial Remedy?
Financial remedy is the procedure by which financial matters are sorted out following on from a divorce or civil partnership dissolution. The matters which the court takes into account in considering financial issues are set out in section 25 of the Matrimonial Causes Act 1973. Financial issues can be resolved through mediation or using the collaborative law process, or by negotiations either directly between the partners or via solicitors. There are lots of different ways of approaching discussions about finances. One solution does not suit everyone and it is a good idea to get some advice early on in the process to find the best way of sorting things out for you.

In all financial remedy cases, you will need to disclose all of your assets and liabilities to each other. This is so that any decisions made are decided with the knowledge of what each of you has. The aim of the financial remedy process is to ensure an agreement will be reached between the partners, which then must be set out in a consent order which is approved by the court. If it is not possible to reach an agreement, then the court will make an order.
