There is only one ground for a divorce and that is that the marriage has “irretrievably broken down”. This is proved by one of five “facts”

  1. Where your partner has committed adultery and you find it intolerable to live with them
  2. Where your partner has behaved in such a way that you cannot reasonably be expected to live with them
  3. Where your partner has deserted you for a continuous period of two years
  4. Where you have been separated for two years and your partner consents to the divorce
  5. Where you have been separated for five years separation

The divorce procedure is laid down by Act of Parliament and Court Rules and involves completing a series of forms. Complications can arise in properly completing the forms or where your partner will not acknowledge receipt of the petition.
